High Court Suspends ban on Muguka in Kilifi, Mombasa, and Taita Taveta Counties
Mombasa, Kenya – In a temporary reprieve for Muguka users, the Meru High Court has suspended the ban on the consumption and distribution of the miraa variety in Mombasa and Kilifi counties. The suspension will remain in effect until July 8, 2024, when the court will hear the case challenging the prohibition.
The ban was initially imposed by the Mombasa and Kilifi county governments, citing public health concerns. However, Muguka traders and consumers contested the ban, arguing that it infringed on their economic activities and cultural practices.
Justice Martha Makungu, who issued the suspension order, stated: “The applicants have established a prima facie case with a likelihood of suffering irreparable damage if the orders sought are not granted.”
Muguka, a stimulant plant similar to khat, is a popular chew enjoyed by some communities in Kenya. The suspension is a welcome development for Muguka users in Mombasa and Kilifi counties, who can now continue consuming the substance while the court case proceeds.
The court’s final decision in July will determine the legality of the ban and the future of Muguka consumption in these counties.
