Eric Omondi risks jail-term for burning National Identification  card

In an attempt to gain access to presidential candidates William Ruto and Raila Odinga, comedian Eric Omondi uploaded a video of himself burning fire to an ID card. The ID card featured an image of Eric and other information that is typically found on National Identification cards for all Kenyans over the age of 18. The song ‘Prisoner’ by Lucky Dube was playing in the background when it was being burned.

It’s unclear whether Eric set fire to his original ID card or whether it’s a fake. Did you know that setting an ID card ablaze is an offense according to the Penal Code? Section 133 of the Penal Code stipulates that destruction of a statutory document “Any person who, knowingly and without lawful authority or excuse, destroys, mutilates, defaces, alters, abandons or fails to preserve any statutory document is guilty of an offense and is liable to a fine not exceeding five thousand shillings or to imprisonment for a term not exceeding six months, or to both,” the act stipulates.

It further explains the ‘statutory documents’ as; “Any license, permit, identity card, record or return or certificate of or relating to employment, and any other record of or document establishing status, identity, qualifications, service, authorization, eligibility or entitlement, made, granted, given or issued under and for the purposes of, and in a form prescribed by any written law, and being of current validity, and includes any part thereof, and any copy thereof made, granted, given or issued as aforesaid.”
