Governor Joho agrees to divorce his Italian wife Giovanni Fazzini

Hassan Joho, the governor of Mombasa, has decided to honor his wife’s wishes by agreeing to their divorce. In response to a divorce action brought by his first wife Madina Giovanni Fazzini, Joho appeared in person at the Mombasa Kadhi’s court. The outgoing Governor of Mombasa did not oppose to his estranged wife’s petition, indicating that they have accepted their new life as ex-spouses.

On January 26, 2022, the divorce papers were filed in the Mombasa Chief Kadhi’s court.Madina, who is of Italian-Somali origin, informed the court in the documents that she and the politician divorced in 2013. She went on to say that after 9 years apart, the two have little hope of repairing their failing marriage. Fazzini and Governor 001 married in February 2011 and have two children, ages nine and eight.
“I am clear and unequivocal that our marriage has broken down irretrievably with no chance of revival, given we have both moved on over the years,” reads part of the documents filed in court. Fazzini further stated that after separating, Joho promptly left their matrimonial home, leaving her to take care of their two children.Fazzini and her children then left the residence in September 2020. “Since the respondent, Joho moved out of our matrimonial home in June 2013, the substance of our marriage has dissipated and has no basis to be sustained from a legal and social standpoint,” she said.
The absence of a husband is one of the grounds for divorce under Islamic law, according to Kenyan laws and precedents. Madina will have to show the court that Joho abandoned her and that their marriage is doomed. Some Islamic law scholars disagree over the length of desertion, with some recommending four years, two years, and one year for others. Another reason for divorce is if the spouse is unable to support and provide for his family. “It is a husband’s job to provide for his wife within his limits.” The right to food is regarded as basic. It is more significant than conjugal rights, because the wife can be patient for months and years whereas one can only survive a month.
