Man who assaulted waiter after being asked to pay KSh. 50 bill jailed for one year or pay KSh. 50,000 fine.

After being asked to pay a Sh50 bill for mandazi and soup, a man punched a waitress and was sentenced to a year in prison or a Sh50,000 fine. On March 12, the incident occurred at a restaurant in Moiben sub-county, Uasin Gishu County. Mike Kiprono, alias Sonko, pleaded guilty to assaulting and causing bodily harm to Mr Martin Wakoli.

Prosecutors had told the Eldoret court that Kiprono punched the server when he was asked to pay Sh50 after consuming mandazi and soup. Kiprono kicked and slapped the plaintiff, stating that the meal he had consumed was insufficient for the eatery to seek Sh50. While the accused fled the scene, the waiter was rescued by other market traders. The Chepkanga Police Station was notified of the event. Kiprono was eventually apprehended and charged before Eldoret Principal Magistrate Onkoba Mogire. He admitted to the crime and entered a guilty plea.
In mitigation, he stated that he was sorry for the occurrence and that he was under the effect of alcohol at the time. “I was inebriated at the time of the occurrence, and I respectfully pray that this court forgives me,” he added. The magistrate advised him not to use drink to justify his actions. The magistrate declared, “After examining your mitigating, this court has fined you Sh50,000 or (you) serve a 12-month jail term.” He has 14 days to appeal the decision.
