MP James Nyikal Proposes Mandatory DNA Tests at Birth

Seme Member of Parliament James Nyikal has proposed the introduction of mandatory DNA testing at birth to establish biological parentage. The proposal has drawn attention to the ongoing debate over paternity verification, parental responsibility and the rights of children.

Under the proposed approach, DNA testing would be conducted soon after a child is born, potentially providing a scientific record of biological parentage from the beginning of a child’s life. Supporters of such a policy could argue that early verification would reduce future disputes and provide greater certainty in cases involving questions of paternity.

However, making DNA testing mandatory would also raise important legal, ethical and privacy concerns. Any such system would need clear safeguards regarding the collection, storage and protection of genetic information. Questions surrounding consent, confidentiality and the rights of children and parents would also require careful consideration.

Nyikal has previously raised issues surrounding parentage and assisted reproductive technology in parliamentary debates, including questions about parental responsibility and DNA evidence.

The proposal could therefore trigger wider discussions in Parliament and among the public about how Kenya should balance scientific certainty, individual privacy and family rights. Any legislative changes would require thorough consultation and careful consideration of their implications.
